Introduction: These terms of service (the “Terms”) govern your use of the BarVoucher website, www.barvoucher.com, and any related mobile applications or services (collectively, the “Service”) provided by BARVOUCHER LLC, a company based in Lincoln, Nebraska (hereinafter “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Eligibility: The Service is intended for individuals who are at least 18 years of age. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

Account Registration: In order to use certain features of the Service, you may be required to create an account and provide certain information about yourself, including your name and email address. You are responsible for maintaining the confidentiality of your account information, including your password, and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or password. We will not be liable for any loss or damage arising from your failure to comply with this requirement.

Content: You are solely responsible for any content or materials that you upload, post, or otherwise transmit through the Service, including text, images, and videos (“User Content”). You agree not to post any User Content that: (a) infringes on the intellectual property rights of any third party; (b) is defamatory, obscene, or otherwise inappropriate; or (c) violates any applicable law or regulation. We reserve the right, in our sole discretion, to remove any User Content that we deem to be in violation of these Terms or that we find otherwise offensive or inappropriate.

In-App Purchases: In-App Purchases are non-refundable membership to BarVoucher and will auto renew unless cancelled. As a benefit of Subscription to BarVoucher Membership, Subscriber to receive negotiated benefits from partnering locations. These benefits are non-transferable and have no cash value. Partners have the right to refuse over-intoxicated, under-age, falsified, or abused promotions at their own discretion.

Intellectual Property: The content and materials on the Service, including without limitation, text, graphics, logos, images, and software, are the exclusive property of BARVOUCHER LLC and our Bar Partners and are protected by United States and international copyright and trademark laws. You may not use any content or materials on the Service for any commercial purpose without the express written consent of BARVOUCHER LLC.

Feedback and Suggestions: We welcome feedback and suggestions from our users. By submitting any feedback or suggestions to us, you agree that we may use and incorporate such feedback and suggestions into the Service without any compensation or credit to you.

Promotions, Contests, and Sweepstakes: We may offer promotions, contests, or sweepstakes through the Service from time to time. Any such promotions, contests, or sweepstakes will be subject to additional terms and conditions, which will be made available at the time of the promotion, contest, or sweepstakes.

Free Trials: We may offer free trials of the Service from time to time. Any such free trial will be subject to the terms of the promotion extended.

Referrals: If you refer a new subscriber to the Service, you and the referral may be eligible to receive a free month of the Service, as specified in the default affiliate plan. Any alteration to this plan must be agreed to in writing.

Advertisement: In order to provide relevant products and services to our users, we may collect and use data such as phone number, email address, and cities of service to personalize advertisements and recommendations. This may include using this data to show you advertisements for products and services that may be of interest to you. We have a privacy policy in place to protect user data and ensure compliance with all applicable laws and regulations. By using the Service, you consent to the collection and use of your data for this purpose.

Termination: We reserve the right, in our sole discretion, to terminate your access to the Service at any time and for any reason, without notice or liability.

Indemnification: You agree to indemnify and hold us and our affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

Governing Law: These Terms and your use of the Service will be governed by and construed in accordance with the laws of the State of Nebraska, without giving effect to any principles of conflicts of law.

Dispute Resolution: Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

Entire Agreement: These Terms constitute the entire agreement between you and us with respect to the Service, and supersede all prior or contemporaneous communications and proposals, whether oral or written.

Waiver: The failure of us to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.
